Appeal schedule

Cemex have appealed against the refusal of the planning applications to extend the operation hours of the Wickwar Quarry.

The Quarry Appeal process is under way. There are several different types of planning appeal. The one that has been chosen by Cemex and S.Glos Council is a “Hearing”.

This type of appeal has several different phases:

  1. Questionnaire –Submission date 28th Jan – A completed questionnaire and attachments submitted to the Inspectorate from S.Glos Council. This includes the background to the case. It also includes submissions of statements from the planning meetings and written consultations from the residents. (See Questionnaire .)
  2. Statements and Representations – Submission date 25th Feb – More comments and additions to those already made during the original Planning Consultation. Any interested party can comment. Submissions must be in triplicate. Request 'result of hearing' to be notified of the outcome. (See Important Contacts for Inspectorate address.)
  3. Final Comments – Due date 17th Mar – Last chance for Cemex or S.Glos. Council to submit additional information or comment on other peoples submissions.
  4. Appeal Event – Date to be arranged – A public meeting where Cemex are able to state their case, then S.Glos Council have an opportunity to state the defence case and then there is an opportunity for anyone else who wants to comment.
  5. Decision Date – Date to be arranged – Notification of the result. This can be up to 7 weeks after the hearing.

It is the responsibility of S.Glos. Officers (Environmental Health and Planning and Enforcement) to defend the rejection decision made by the Planning Committee.

Costs can be awarded at the end of the proceedings.

An appeal can only be challenged in the High Court, and only on either the grounds that due procedure was not followed or the inspectorate exceeded their powers.
